1. Agreement to Terms

Welcome to ModelToMake. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our platform.

These Terms constitute a legally binding agreement between you and ModelToMake Inc. ("ModelToMake," "we," "us," or "our") governing your use of our website, mobile applications, and services (collectively, the "Platform").

ModelToMake is a 3D model marketplace and manufacturing platform that provides:

• A marketplace for browsing, purchasing, and downloading 3D models
• AI-powered 3D model generation tools
• On-demand 3D printing and manufacturing services
• Creator tools for uploading, managing, and selling 3D models
• Custom design and prototyping services
• Global shipping and delivery

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Types

We offer different account types:

• Buyer Account: For browsing and purchasing 3D printed products
• Creator Account: For uploading and selling 3D models
• Business Account: For bulk orders and custom manufacturing

4. Intellectual Property Rights

4.1 Platform Content

The Platform, including its content, features, and functionality, is owned by ModelToMake and is protected by international copyright, trademark, and other intellectual property laws.

4.2 Creator Content

Ownership: You retain ownership of the intellectual property rights in the 3D models you upload to the Platform.

License Grant: By uploading content, you grant ModelToMake a worldwide, non-exclusive, royalty-free license to:

• Display your models on the Platform
• Manufacture products based on your models for buyers
• Use thumbnails and previews for marketing purposes
• Store and transmit your files as necessary

4.3 Buyer Rights

When you purchase a 3D printed product, you receive:

• The physical 3D printed product
• Personal use license (unless commercial license is purchased)
• You do NOT receive intellectual property rights to the 3D model itself

4.4 Copyright Infringement

We respect intellectual property rights. If you believe content on our Platform infringes your copyright, please submit a DMCA takedown notice to dmca@modeltomake.com

5. Orders, Payments, and Pricing

5.1 Pricing

Prices are displayed in your selected currency and include:

• Base price (set by creator or calculated from material/size)
• Manufacturing costs
• Shipping fees (calculated at checkout)
• Applicable taxes (varies by jurisdiction)

5.2 Payment

We accept major credit cards, PayPal, and other payment methods. Payment is processed securely through our payment partners. By placing an order, you authorize us to charge your selected payment method.

5.3 Order Processing

Production Time: 3-7 business days (varies by material and complexity)
Shipping Time: Varies by destination (3-30 days)
Tracking: Provided via email once shipped

5.4 Creator Earnings

Creators earn a commission on each sale:

• Standard commission: 70% of sale price
• Premium creators: Up to 85% commission
• Payments processed monthly via PayPal or bank transfer
• Minimum payout threshold: $50 USD

6. Returns, Refunds, and Cancellations

6.1 Cancellation

Before Production: Full refund available
During Production: Partial refund (up to 50%)
After Shipping: No cancellation possible

6.2 Returns and Refunds

We accept returns within 30 days of delivery if:

• Product is defective or damaged
• Wrong item was shipped
• Product does not match description

Note: Custom-made and personalized items cannot be returned unless defective. Contact support@modeltomake.com to initiate a return.

6.3 Quality Guarantee

We guarantee the quality of our 3D printed products. If you are not satisfied with the quality, contact us within 7 days of delivery for a replacement or refund.

7. AI-Generated Content

7.1 AI Model Generation

Our AI-powered tools allow you to generate 3D models from text or images. By using these tools:

• You own the rights to AI-generated models you create
• You are responsible for ensuring generated content does not infringe third-party rights
• We may use aggregated, anonymized data to improve our AI models

7.2 Usage Restrictions

AI-generated models must not be used for:

• Illegal purposes
• Creating weapons or dangerous items
• Infringing on trademarks or copyrighted characters

8. User Conduct

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Harass, abuse, or harm other users
• Provide false information
• Create multiple accounts to circumvent restrictions
• Reverse engineer or attempt to extract our proprietary algorithms
• Use the Platform for unauthorized commercial purposes
• Upload illegal, obscene, or harmful content
• Interfere with the operation of the Platform

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Platform will be uninterrupted or error-free
• 3D printed products will meet your specific requirements
• All defects will be corrected
• The Platform is free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODELTOMAKE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits or revenue
• Loss of data
• Business interruption
• Personal injury or property damage

Our total liability shall not exceed the amount you paid for the specific product or service in question.

11. Indemnification

You agree to indemnify and hold harmless ModelToMake, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Platform

12. Dispute Resolution

12.1 Arbitration

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12.2 Class Action Waiver

You agree not to participate in class actions, class arbitrations, or representative actions against ModelToMake.

13. Termination

We may suspend or terminate your account if:

• You violate these Terms
• We detect fraudulent activity
• Your account is inactive for 12+ months
• We discontinue the Platform

Upon termination, your right to use the Platform ceases immediately. Creator earnings will be paid out according to our standard payout schedule.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or Platform announcement. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
